controversies

  • Gogoi was part of the Supreme Court bench that heard the “Soumya murder and rape case”. The bench set aside the death sentence awarded by the High Court and sentenced the accused to life imprisonment for rape and other offenses involving physical injury to the victim. This decision was criticized by the public and many political leaders. Former Supreme Court judge Justice Markandey Katju also expressed his opinion against the decision. He was summoned by the Supreme Court due to “contempt of court”.
  • On 12 January 2018, Gogoi and three other Supreme Court judges became the first judges in the history of India to hold a press conference. He alleged that there were problems in the functioning of the Supreme Court of India and failure in the justice delivery system and allocation of cases. He also questioned the then Chief Justice of India Dipak Misra as to why Justice Arun Mishra was allotted the hearing of CBI judge BH Loya’s death case. Justice Mishra condemned the actions of the judges and said that the press conference was held to malign their image.

  • On 19 April 2019, a former female employee of the Supreme Court of India alleged that Gogoi had sexually harassed her. She said that in October 2018, Gogoi had sexually harassed her on two separate occasions in his home office. She also said that she was fired from her job in December 2018 and the real reason for the termination of her employment was that she had rejected Gogoi’s sexual advances. However, on 6 May 2019, an inquiry panel constituted to probe the case acquitted Gogoi of all charges.

  • On 11 May 2023, a defamation case was initiated against him by Abhijeet Sharma, a social activist from Guwahati. Sharma filed a defamation suit of Rs 20 lakh. A fine of Rs 1 crore has been imposed against Ranjan Gogoi in the civil judge court in Kamrup (Metro) district and Guwahati on allegations that Gogoi’s book ‘Justice for the Judge’ contained objectionable material related to the National Register of Citizens update exercise. Is. Sharma also demanded a ban on the book. According to Sharma, Gogoi had falsely implicated him in his autobiography, which stated that NRC officials were attacked by local people, including Abhijeet Sharma. Gogoi wrote in his biography,

At the local level, personal attacks on SCNR (Hajela) and indirect attacks on the judges, especially me, by local politicians and especially Assam Public Works Chairman Abhijit Sharma convinced us (the bench) that orders should be given in the former state. Passed to protect NRC Coordinator Prateek Hajela from undue harassment and anticipated loss. The division bench passed the order on 18 October 2019 for his deputation on inter-cadre transfer to his home state Madhya Pradesh.

In 2017, Sharma accused Hajela of being involved in a scam related to the NRC update process, but he found the allegation baseless. Ranjan Gogoi, who was heading the Supreme Court bench at that time, initiated a suo motu contempt case against Sharma and directed him to tender an unconditional apology before the court. Sharma said,

With sufficient evidence, I raised concerns over misuse of funds in the NRC process and the Auditor General of India found it correct. As a result, Hajela was removed from his post and transferred from Assam.”

Sharma pointed out another flaw in Gogoi’s biography where Gogoi wrote,

Subsequent events such as filing of FIR against Hajela and other NRC officials; The allegations of corruption and threats to order a CBI inquiry, coupled with massive misinformation and its widespread publicity in the media, have led me to believe that the unusual order for inter-cadre transfer of Hajela has been passed by invoking Article 142 of the Constitution. The bench was completely justified. ,
