Wendy Moore, 45, will be released in a little under five years, but she is hoping that a motion she filed in U.S. District Court in March would allow her to leave federal prison much sooner.

After her traditional appeals were unsuccessful, Moore already tried to have the sentence resentenced once. In 2014, Moore and her ex-boyfriend Chris Latham, a former banker, were found guilty of participating in a failed murder-for-hire plot against Nancy Cannon, a real estate agent and state lottery employee. Latham received a 10-year sentence on one count, while Moore is currently serving a 15-year prison term for four offences.

When Latham and Moore, a secretary at his office, first started dating, Moore was an executive at Bank of America in Charleston. Authorities claim that they plotted to assassinate his wife during his difficult divorce. When a Charleston police officer stopped Aaron Wilkinson, a Kentucky man trying to acquire heroin on the city’s East Side, in April 2013, the scheme fell apart.

Wilkinson exposed the murder scheme and led detectives to a “hit packet” with crucial information about Cannon when police discovered a gun in his car. Through a relationship with Moore’s ex-husband, Samuel Yenawine, who later committed suicide while awaiting trial, Wilkinson had become involved in the scheme.

Wilkinson testified against Latham and Moore, becoming the government’s star witness and reducing his potential prison sentence. The Charleston Affair, a Dateline segment, was based on the rapidly gaining national attention for the case.

Moore is expected to be released in January 2026 from a federal prison in Tallahassee, Florida. Latham is detained in Wildwood, Florida, almost three hours away. The federal Bureau of Prisons has determined that he will be eligible for release in February of next year.

Moore has previously used a variety of defences to get her conviction and imprisonment overturned, including allegations of incompetent legal representation and charges that Latham used her as a pawn in his illegal schemes. Latham has also contested his conviction, claiming the story was made up and taken “straight out of a movie script” by a sociopath. All of those justifications fell flat.

Moore is relying on a convoluted legal defence this time around that builds on a 2019 U.S. Supreme Court ruling in a Texas robbery case involving a string of cigarette heists. The same federal conspiracy legislation that helped put Moore and Latham in jail also led to the conviction of the hold-up men.

The relevant legislation permits harsher criminal penalties for using, carrying, or owning a handgun in connection with any federal “crime of violence or drug trafficking crime.” The supreme court, however, determined that the law’s definition of violent felonies was unconstitutionally ambiguous and offered “no reliable way to determine which offences qualify as crimes of violence.” The court concluded that the law is invalid as a result.
