In 2018, he contested and won the Athani assembly seat as a Congress candidate, defeating BJP candidate Laxman Savadi by 2331 votes. Following the 2018 Karnataka Legislative Assembly elections, HD Kumaraswamy of JD(S) was sworn in as Chief Minister with the support of Congress, BSP, KPJP and an independent MLA. In July 2019, Karnataka Assembly Speaker KR Ramesh Kumar disqualified independent MLA R Shankar and two Congress-JD(S) MLAs Ramesh Jharkiholi and Mahesh Kumathalli. The Speaker announced that the MLAs have been disqualified as members of the 15th State Legislative Assembly under Para 2(1)(a) of the Tenth Schedule of the Constitution and Article 191(a) of the Constitution of India. In a video clip, Kumathalli was seen asking a man to give him “quarters” in the flood-hit area of ​​Athani taluk.   • In 2019, Pramod Hiremani, who is the Youth Congress President in Athani, filed a habeas corpus petition before the Karnataka High Court, alleging that Athani MLA Mahesh Kumathalli is missing and possibly in illegal detention.
