News about Heidi Yates
Heidi Yates, the ACT’s Crime Victims Commissioner, said she had “carefully considered” [her] responsibility” to Brittany Higgins when she made the decision to accompany Ms. Higgins to court every day of the Bruce Lehrmann trial.
Ms Yates told the Inquiry Board on Thursday 1 June the allegations made after the trial that it was wrong for her to be “the public face of support” was “very concerning to her”. .
“I stress that, in my view, these concerns may reflect a misinterpretation of my function in the legal system,” she said.
Ms Yates testified at the inquest that she had an obligation to assist the complainant as VCC, while recognizing the defendant’s right to a fair trial and the right to a presumption of innocence under the Human Rights Act.
Ms Yates “fully conceded that possibility” when asked by coroner Walter Sofronoff KC if there were any circumstances where VCC services “would be at risk of leading to avoidable claims that your client actually victim” as opposed to a complainant who meets the requirements of the law and has the right to receive supportive services.
Yates said: “No,” when Sofronoff asked her if she felt she had “passed through.” [a] line” by “siding with Mrs. Higgins in a case that has become known to the public.”
“I think I have thought carefully about my obligation to Mrs. Higgins to [Victims of Crime] of the Act, and at the same time I am aware of my obligations under the Human Rights Act,” the author stated.
Ms Yates also told the inquest that she repeatedly sought permission from the police and DPP Shane Drumgold, including initially verbally and via email with Detective Inspector Marcus Boorman about whether she would be named as a contact person. Miss Higgins’ contact with the police. Mr Drumgold, with whom she also discussed the option to enter the courtroom with Ms Higgins, did not express concern about it.
Erin Longbottom KC, an attorney assisting with the investigation, asked Ms Yates whether she would decide to return to court with Ms Higgins publicly if she had a chance to look back.
“It’s hard to say if I would have made a different choice if I could go back in time and think about what happened. I’m sure, based on the information I had at the time, I’d have given it a go. made the right choice considering all the factors that I should have taken into account,” she retorted.
Are there any lessons to be learned from this case regarding the possibility that my intention to get past her unnoticed might not have been obvious? Yes, and I would definitely consider that if the victim asks me to be with them in the future.
