Alec Baldwin alleges bias on the part of prosecutors shortly before his manslaughter trial Oxide director of photography Halyna Hutchins.
“State prosecutors have engaged in this misconduct, publicly dragging Baldwin into a cesspool created by his wrongdoing, disregarding the fact that serious criminal charges have been hanging over his head for two and a half years,” a motion to dismiss was filed Thursday in New Mexico court reads (via Deadline). “Enough is enough.”
Recharged in January and potentially facing up to 18 months in prison if convicted, the Emmy winner will begin his criminal trial in Santa Fe on July 9.

As time ran out, attorneys from Quinn Emanuel Urquhart & Sullivan of New York and LeBlanc Law of Albuquerque criticized special prosecutors Kerry Morrissey and Jason Lewis. They also challenged everyone involved in the investigation of the events of that fateful day at the Bonanza Creek Ranch.
“This is an abuse of the system. “An abuse of an innocent person whose rights have been trampled,” reads the 52-page motion signed by attorney Luke Nikas. “Had the State conducted the grand jury process in accordance with New Mexico law, the outcome would have been different. In short, the State withheld substantial exculpatory and favorable evidence from the grand jury. Therefore, the Court should dismiss the indictment.”
In the court case, Baldwin’s defense argues that the Colt .45 could have fired without pulling the trigger. Referring to Michael Haag, a state firearms expert who testified before the Grand Jury, the motion mentions that his testimony “omitted facts. Including that FBI evidence established that the gun was fired without pulling the trigger when the gun was fully loaded with six bullets, as it was on the day of the incident.”
After the tragic shooting in 2021 that also left people injured Oxide director Joel Souza, Baldwin has maintained that he did not pull the trigger. Conflicting reports from the FBI and other sources may call his position into question. However, Thursday’s motion could cast doubt on the current narrative.
Oxide wrapped production in mid-2023 following additional filming in Montana. Souza reprized the role of director, while Baldwin resumed his position as star and producer. Meanwhile, gunsmith Hannah Gutiérrez-Reed was not invited to return to the production. The completed project is now seeking a buyer.
