Jiah Khan committed suicide by hanging herself from the ceiling fan of her bedroom at her residence in Sagar Sangeet Apartment, Juhu, Mumbai on 3 June 2013. Rabia Khan’s claims and legal proceedings

Based on the suicide note, Sooraj Pancholi was arrested on 10 June 2013 under section 306 of the Indian Penal Code (IPC) for abetment of suicide; However, the Mumbai High Court granted him bail on 1 July 2013, saying that he could not be held entirely responsible for the incident.

Rabia has described Jiah’s death as murder and has blamed Sooraj Pancholi for it. He has also alleged financial irregularities involving money and jewellery. In an interview, she said that Jiah had given a significant amount of money to Sooraj Pancholi to buy jewelery for her sister’s 21st birthday; However, Suraj failed to deliver the jewelery or inform Jiah about the money. Despite apologizing and sending flowers, which Jiah rejected, she confronts Sooraj about the money. Jiah never revealed the outcome of that confrontation. Rabia further reveals that Jiah had shared the biometric lock of her apartment with Sooraj, making her suspect him for Jiah’s death. On the other hand, Sooraj claimed that Jiah was struggling with depression and he had tried many times to help her overcome it. He further claimed that he informed Rabia about the situation, but she did not take any action, which resulted in Jiah committing suicide. On 1 October 2013, Rabia approached the Bombay High Court, alleging that her daughter Jiah Khan was murdered and demanding that the Central Bureau of Investigation (CBI) investigate the case. On July 2, 2014, the case was transferred to the CBI, which later filed a charge sheet against Sooraj Pancholi. In 2016, the CBI denied any foul play and informed the High Court that Jiah Khan’s death was a suicide. Subsequently, Rabia hired a British forensic expert named Jason Payne James, who alleged that Zia’s death was ‘compounded’. Rabia later filed a petition in the Bombay High Court, requesting a Special Investigation Team (SIT) to take over the case; However, the Bombay High Court rejected his petition in February 2017.

In September 2017, Rabia Khan had written a letter to Prime Minister Narendra Modi pleading for justice. He then approached the special CBI court in Mumbai and filed a petition for further investigation into the case, which was later rejected. In 2021, Jiah’s case was reassigned to a special CBI court after the sessions court claimed it lacked jurisdiction over the CBI investigation. In 2022, the Bombay High Court rejected Rabia’s petition seeking a fresh investigation into the case. On April 28, 2023, the special CBI court in Mumbai acquitted Sooraj Pancholi in the Jiah Khan suicide case due to lack of evidence. The court said in its verdict that the evidence against Sooraj Pancholi was ‘vague and general’, and Jiah was ‘a victim of her own emotions’. Special CBI court judge AS Sayyed said Jiah had suicidal tendencies which only Sooraj Pancholi knew about. The judge further said that Sooraj could not give his time to Jiah as he was focusing on his acting career, and Rabia attempted to prove that Jiah had not committed suicide but was murdered, which the prosecution had said. In the present case, it cannot be ignored that the deceased had suicidal tendencies. She had attempted suicide once before and at that time the accused had called a doctor. The accused had treated her and tried to bring her out of depression. At the relevant time the accused was pursuing his career in acting and could not devote adequate time to the deceased. However on the earlier occasion, when she had tried to commit suicide, the accused had saved her and helped her come out of depression. Rabia tried to show through her evidence that Jiah never committed suicide and that she was murdered by the accused (Pancholi). However, this is not a matter for the prosecution. While the prosecution’s case was suicide, Rabia continued to claim it was murder. By giving such blatantly contradictory evidence the complainant himself destroyed the prosecution’s case.

After the court’s verdict in Jiah Khan’s murder case, Rabia Khan said that Sooraj Pancholi is not accused of suicide but of instigating murder. Responding to the decision in an interview, Rabia expressed her intention to challenge the decision in the High Court. He said,
