Early years in Yemen

In 2016, she filed a complaint at a police station in Sanaa, but instead of solving the problem, she was jailed for 16 days as per Yemeni laws. She came out of jail only when Mahdi presented a fake marriage certificate in the court. Nimisha claimed that Mahdi continued to harass her in different ways and even confiscated her passport and said,
He confiscated my passport, he forced me to live with him. He would come to my house drunk and physically attack me, threaten me into obeying him, and hurt me. He would also bring his friends to my house at night and force me to have sex with them. I used to run outside to save myself every time. Those were sleepless nights for me, there was no one to help or support me. I was completely alone. Yemen is not a place where one can see women out at night. But I will escape the attacks and run away from my house through the road.
Tommy Thomas said in an interview that Nimisha was fluent in Arabic, but she could not read the language. When the documents were being prepared, Mahdi reportedly got 67% of the clinic’s shares registered in his name, with 33% of the shares in Abdul Latir’s name. Mahdi also registered other types of clinic equipment and vehicles in his name. Thomas alleged that Nimisha had used around 22 SIM cards to contact him as whenever Mahdi confiscated one SIM card, she managed to get another SIM card. Several other police cases related to land fraud, vehicle fraud and money fraud were also registered against Mahdi.

Nimisha claimed in an interview that Mahdi was often lodged in a nearby jail, whose warden was known to Nimisha. The jail warden suggests to Nimisha that she can render Mahdi unconscious and get his passport from him so that he can return to India. When Nimisha got the chance, she injected Mahdi with an anesthetic; However, it had no effect on him as he was reportedly a drug addict.

On 25 July 2017, while Mahdi was taking drugs at his home, he injected her with ketamine. Mahdi fell to the ground after a few minutes and continued screaming before passing away at the age of 24. Nimisha quickly called Hanan, a fellow Yemeni nurse who lived down the road from her house in Al Deyadh and explained the situation to her. Hanan was aware of Nimisha’s torture at the hands of Mahdi, and he decided to cut her body into pieces and throw it in a nearby water tank. After seeing this, Nimisha allegedly had an anxiety attack and consumed pills while Hanan cut Mahdi’s body into pieces. After a few days, some people complained of foul smell coming from the water tank, following which police found Mahdi’s body parts and Nimisha and Hanan were arrested in August 2017.

Death penalty and rescue attempt
Following their arrest, Nimisha was awarded death sentence by a local court in August 2020 while Hanan was sentenced to life imprisonment. On 7 March 2022, an appeals court upheld his death sentence; However, the court offered a lifeline by saying that Mahdi could avoid the death penalty if his family forgave him because under Islamic law, the death penalty can be avoided if the victim’s family forgives the convict. Forgiveness may be granted, and may include payment of blood money (compensation paid to the victim’s family). Nimisha wrote a letter in Malayalam which read,
I did not commit murder. To improve my life, with my husband’s permission, I took a certain path. But I fell into the trap of some people whom I trusted and ended up in a tragic situation.

In 2020, a forum called Save Nimisha Priya International Action Council was established to help her. Subhash Chandran KR, a Delhi-based lawyer, filed a case in the Delhi High Court to help Nimisha, following which a seven-member delegation was formed to meet Mahdi’s family to negotiate payment of the blood money. The delegation included Premkumari and Priya’s daughter, Michelle Tommy Thomas, Subhash Chandran KR and another Delhi-based lawyer Deepa Joseph, who is the vice-chairman of the Action Council, council convenor Babu John, Rafiq Ravuthar of the Center for Indian Policy, and others. Diaspora Studies, and Nizar Kochery, an Indian lawyer based in Doha; However, he could not travel to Yemen due to visa problems. Yemen-based activist Samuel Jerome, the first person Priya reached out to for help when she was arrested in 2017, said Mahdi’s family showed no signs of hostility when they met them in court during the hearing. In April 2022, it was reported that Mahdi’s family agreed to a compensation (blood money) of 50 million Yemeni Riyals (about Rs 1.5 crore).

On 17 November 2023, Communist Party of India (CPI) Rajya Sabha MP Binoy Viswam wrote a letter to Indian Prime Minister Narendra Modi to take cognizance of the case and help Nimisha Priya.
