Controversies
Agnivesh Agarwal, Kolkata vs Additional Commissioner of Income Tax, 2017
In this case, Agnivesh Agarwal appealed against an order by the CIT(A) (Commissioner of Income Tax (Appeals)) dated 30 June 2014 for the Assessment Year 2009-10. The dispute centred around an additional income amount of Rs.2,40,000/- imposed by the Assessing Officer (AO). Agnivesh Agarwal’s appeal revolved around two main points. Firstly, he disagreed with the CIT(A)’s confirmation of the AO’s income addition, arguing its lack of proper reasoning and the lack of a show cause notice (A “show cause notice” is a formal request asking for an explanation on the reason for bringing about a legal matter). Secondly, he contended that the CIT(A) didn’t adequately consider his explanation and failed to grant him an opportunity to respond. Agarwal explained that the Assessing Officer’s income addition lacked a clear basis and that family members’ earnings should be factored in to cover his expenses. The CIT(A) rejected Agarwal’s arguments, siding with the Assessing Officer. However, upon review, the Tribunal found the Assessing Officer’s addition to be arbitrary and lacking proper justification. They also noted the CIT(A)’s insufficient consideration of Agarwal’s explanation and the absence of clear reasoning for the Assessing Officer’s sum of Rs.2,80,000/-. The Tribunal deemed Agarwal’s argument about using family income for expenses reasonable, and consequently, they ruled in Agarwal’s favour. The income addition was removed on August 31, 2017.
